View Speed Test – Terms & Conditions

These Terms & Conditions (“Terms”) form a legally binding agreement between you (“you,” “your,” or “User”) and View Speed Test (“View Speed Test,” “we,” “our,” or “us”) governing your access to and use of the View Speed Test website, browser extensions, mobile applications, APIs, and any related services (collectively, the “Service”). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility & Acceptance

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that (a) you have capacity to form a binding contract; and (b) your use complies with all applicable laws and regulations.

3. Modifications to the Terms

We may revise these Terms at any time. The “Effective Date” above reflects the most recent update. We will post changes on the Site or provide another reasonable method of notice. Continued use after an update constitutes acceptance of the revised Terms.

4. Description of the Service

The Service measures and displays your internet connection metrics by sending and receiving data packets between your device and test servers. Results may vary due to network congestion, device configuration, browser type, VPN usage, and other factors.

5. Ownership & Intellectual Property

  1. Service Content. All software, text, graphics, logos, and other materials forming part of the Service (“Content”) are owned by View Speed Test or its licensors and are protected by copyright, trademark, and other laws.

  2. License to You. We grant you a limited, revocable, non‑exclusive, non‑transferable, and non‑sublicensable license to access and use the Service solely for personal, non‑commercial purposes in accordance with these Terms.

  3. Feedback. If you provide comments or suggestions, you grant us a perpetual, royalty‑free right to use them without restriction or compensation.

6. User Obligations & Prohibited Conduct

You agree not to:

  • Use the Service in any unlawful manner or for any fraudulent purpose;

  • Interfere with or disrupt servers, networks, or security features;

  • Run automated scripts (e.g., bots) that overload or attempt to scrape the Service;

  • Reverse engineer, decompile, or disassemble any portion of the Service;

  • Misrepresent test results or use them to make deceptive claims;

  • Upload viruses, malware, or any harmful code.

We may investigate violations and cooperate with law‑enforcement authorities.

7. Test Results & Data Usage

  • Informational Only. Speed‑test results are provided “as is” for informational purposes and are not guaranteed to be accurate, complete, or suitable for regulatory, contractual, or professional use.

  • Aggregated Metrics. We may aggregate and anonymise test data for analytics, research, or commercial insights, as outlined in our Privacy Policy. Aggregated data no longer identifies individual users.

8. Third‑Party Links & Services

The Service may contain links to third‑party websites or integrations with third‑party tools. We are not responsible for the content, accuracy, or policies of third parties. Your dealings with third parties are solely between you and those parties.

9. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING (BUT NOT LIMITED TO) MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND ACCURACY OF RESULTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  1. Indirect Damages. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA, OR GOODWILL).

  2. Cap on Direct Damages. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SERVICE WILL NOT EXCEED USD 50.

  3. Exceptions. Nothing in these Terms excludes liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless View Speed Test, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use (or misuse) of the Service, violation of these Terms, or infringement of any third‑party rights.

12. Termination

  • By You. You may stop using the Service at any time.

  • By Us. We may suspend or terminate your access without notice if we reasonably believe you have violated these Terms or pose a risk to the Service.

  • Effect. Upon termination, all licenses granted to you end immediately. Sections 5, 7, 9–12, 14–16 survive termination.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict‑of‑law principles. Any dispute arising out of or relating to the Service shall be submitted to the exclusive jurisdiction of the state or federal courts located in Delaware, unless applicable mandatory consumer laws in your country provide you with additional rights.

14. Dispute Resolution & Mandatory Arbitration (US Users)

If you reside in the United States, you and View Speed Test agree to resolve any disputes by binding arbitration on an individual basis, except for (a) small‑claims matters, and (b) claims seeking injunctive relief for intellectual‑property infringement. You waive the right to a jury trial and to participate in class actions. Full arbitration rules are available upon request.

15. Severability

If any provision of these Terms is held unenforceable, that provision will be modified to reflect the parties’ intention, or severed if necessary, and all remaining provisions will remain in full force.

16. Entire Agreement

These Terms, together with the Privacy Policy and any additional guidelines we post, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings.
